Cherished Mini Warranty/What will the dealer say today

You may, or may not have noticed on the Faults and Fixes thread that my 54 plate MCS is currently suffering from a gearbox/clutch issue, where randomly it gets hard to change gear or on occasions completely impossible, leaving you stranded with no gears at the traffic lights.

The car was bought at the end March/start of April as a "Cherished" Mini.

Since then I have covered just under 2000 miles. (Its now on 35k).

The issue actually happened on the day we picked it up but kind of ignored it as we didnt know if it was normal, and it only happened the once. Now its becoming a regular occurance, forcing me to lose all confidence in the car as you play russian roulette with the gears. Will it/Wont it work today.

The car was taken in today into a dealer (not the original one I bought it from as they are 200 miles away). I read on another forum somewhere, where a guy had the same issue and took it into the same dealer I took mine to today.. His problem was down to bent clutch fingers which stopped it linking with the gearbox. I told them this and they are going to check it out.

So now its in the hands of the dealers.. I have read that the clutch isnt covered under the warranty as its a wear and tear item.. So....

Place your bets.

Do you think..


a) It will be fixed OK under warranty as it will be deemed a defect
b) Claim wear and tear and try and stitch me up with a HUGE bill
c) They drive me to drink with worry about the impending phone call.
d) End up with me spending hours on the phone to Mini/the dealer I bought it from, this afternoon, trying to find someone to pay for it
e) One/Several/Or All of the above.

Depends what the fault is found to be. But it doesn't sound like a worn part fault to me.

With the car having only covered 35k & and being under cherished warranty the answer should be A.

I had my clutch and flywheel replaced under cherished warranty scheme.

I also had a clutch replaced under warranty do it 'squeaking' at the bite point on cold starts - the car had over 20k miles on it

I would like to hope A.

If they do deem wear and tear though, I would imagine given the age/mileage you may well get a goodwill gesture/contribution.

News Update

I just had a call from the dealer..

They have found a problem with the gearbox, and have ordered a replacement one to be fitted for free under the warranty..

He did give me an advisory for later on that when they get the gearbox out, then they recommend I get a new clutch as this isnt covered unless it is a defect. Basically as the gearbox will be out anyway, he said that it would cost about £350 instead of £1300.

He said if I say "No", and they put it all back together and send me on my way and then it goes wrong again, I will be looking at £1300 for a new clutch. I am assuming that if they take the clutch out and its a defect then it will be free.

This sound normal?
